Terms and conditions
These terms govern your use of the Practitioner Ethics website, courses, programs and tools. Please read them before you buy or use a course.
1. About these terms
In these terms, "Practitioner Ethics", "we", "us" and "our" mean the business operating this website, whose details are shown at the foot of this page. "You" means the person using the website or buying or completing a course, and, where a purchase is made for an organisation, that organisation as well.
By creating an account, buying a course, program, tool or team licence, or using our website, you agree to these terms. If you do not agree, please do not use the website or our courses. Our privacy policy, refund policy and accessibility statement form part of how we deal with you and should be read with these terms.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
2. What we provide
Practitioner Ethics provides independent online education on ethics, professionalism and compliance for registered health practitioners in Australia. Our services include self-paced courses, programs that group related courses, practical tools and templates, team licences for organisations, and related information on our website.
Our courses are educational. They explain codes, standards, guidelines and law in general terms and help you reflect on your own practice. They are not legal advice, clinical advice or advice about any particular regulatory matter, and they do not replace the codes, standards and guidelines issued by your National Board, or advice from your professional indemnity insurer, medical defence organisation or lawyer.
3. Independence, CPD and regulatory matters
- Practitioner Ethics is not affiliated with Ahpra, any National Board, any professional association or any government body.
- Our courses are not accredited, not approved and not endorsed by Ahpra, any National Board or any professional body.
- Each course states an approximate learning time. You are responsible for recording the time you actually spend and for deciding whether a course is suitable for your CPD plan under your Board's CPD registration standard.
- If you intend to use a course in connection with a notification, complaint, condition, undertaking, panel or tribunal, you are responsible for obtaining advice about whether it is suitable and whether any approval is needed. No course can guarantee any regulatory outcome, and we accept no responsibility for the decisions of Ahpra, a National Board, a panel, a tribunal or an employer.
4. Your account
- You must give accurate information when you create an account, including the name you want shown on your certificates, and keep it up to date.
- Your account is personal to you. You must not share your login details or allow anyone else to use your account, complete assessments or reflective accounts on your behalf, or use a certificate issued in your name.
- You are responsible for activity on your account. Tell us promptly at support@practitionerethics.com if you believe someone else has accessed it.
- We may suspend or close an account if we reasonably believe these terms have been breached, for example where a course has been completed by someone other than the account holder. Where we do so, we will act reasonably and tell you why, unless the law prevents us.
5. Assessments and certificates
To receive a certificate of completion you must work through the course, pass its final assessment at the stated pass mark and complete the reflective account. The assessment and reflective account must be your own work.
A certificate confirms that the named person completed the course and passed its assessment on the date shown, and states the course's approximate learning time. It is not a qualification, a licence, a registration or a statement of competence, and it does not indicate any recognition of the course by Ahpra or a National Board.
We may withdraw a certificate if we reasonably believe it was obtained in breach of these terms, for example by another person completing the assessment, and we may tell a person who asks us to confirm the certificate that it has been withdrawn.
6. Prices, payment and team licences
- Prices are shown on the website at the time of purchase. We may change prices at any time, but a change will not affect a purchase you have already made.
- Payment is taken at the time of purchase through our payment provider. Your purchase is confirmed when payment is successful and you receive a receipt.
- Discounts, bundles and bulk-buy offers apply only as described on the website at the time of purchase and cannot be combined unless we say so.
- Where an organisation buys a team licence, the organisation may allocate places to its staff and may see enrolment and completion information for those places. Each learner still has a personal account and receives a certificate in their own name. Any separate written agreement with an organisation applies in addition to these terms and prevails if there is an inconsistency.
Refunds are dealt with under our refund policy and the Australian Consumer Law.
7. Using course content
All content on the website and in our courses, including text, case illustrations, assessments, templates, tools, layout and design, is owned by or licensed to Practitioner Ethics and protected by copyright.
When you buy a course, we grant you a personal, non-exclusive, non-transferable licence to access and use it for your own professional learning. You may download or print reasonable extracts, such as your certificate, your reflective account and quick-reference guides, for your own records.
You must not, without our written permission:
- copy, reproduce, publish, sell, share or distribute course content or assessment questions;
- use course content to deliver training to others, or to create a competing course or product;
- use automated tools to copy, scrape or download content from the website, or to train software on it;
- remove copyright or other notices from any content.
Your reflective accounts and other material you write remain yours. You give us permission to store and display them in your account so that we can provide the service.
8. Acceptable use
When using the website you must not:
- break any law or infringe anyone's rights;
- upload or send patient information, clinical records or other information that identifies a third party, unless it is necessary and lawful, and in any case not into reflective accounts;
- attempt to interfere with, test the security of or gain unauthorised access to the website, our systems or other users' accounts;
- introduce viruses or other harmful code;
- use the website to send unsolicited messages or to harass anyone.
9. Availability and changes to courses
We aim to keep the website and courses available and working properly, but access may occasionally be interrupted, for example for maintenance or because of problems outside our control. We will try to give notice of planned interruptions where practicable.
Because codes, guidelines and the law change, we update courses from time to time. Updates may change content, assessments or learning time. We will not make changes that substantially reduce the value of a course you have bought and not yet completed without offering you a reasonable remedy.
We may withdraw a course from sale. If you have already bought it and not yet completed it, we will give you reasonable time to complete it, offer a comparable course, or refund you.
10. Consumer guarantees and our liability
Our services come with consumer guarantees under the Australian Consumer Law that cannot be excluded, including that they will be provided with due care and skill and will be reasonably fit for any purpose you make known to us. Our refund policy explains the remedies available if we fail to meet them.
To the extent permitted by law, and subject to the paragraph above:
- we are not liable for any loss arising from your reliance on general educational content as if it were advice about your own circumstances, or from any decision of a regulator, panel, tribunal or employer;
- we are not liable for indirect or consequential loss, such as loss of income or opportunity;
- where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with the consumer guarantees is limited, where the law allows, to supplying the services again or paying the cost of having them supplied again.
Nothing in this section limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited.
11. Links and third-party services
Our courses and website link to official sources such as Ahpra, the National Boards and Commonwealth regulators. We do not control those sites and are not responsible for their content or availability. Payment and some other functions are provided by third parties, whose own terms may also apply.
12. Ending your use
You can stop using the website at any time and ask us to close your account by emailing support@practitionerethics.com. Before closing your account, download any certificates and reflective accounts you want to keep, because once an account is closed we may not be able to restore them. We may keep some records after closure as described in our privacy policy.
Sections of these terms that by their nature should continue, such as those on intellectual property, liability and governing law, continue after your account is closed.
13. Changes to these terms
We may update these terms from time to time, for example to reflect changes to our services or the law. The current version is always on this page. Changes apply from the date they are published and do not affect purchases already made under earlier terms, except where a change is required by law.
14. Governing law and disputes
These terms are governed by the laws in force in Australia and in the state or territory in which our business is registered, as shown in the business details shown at the foot of this page. If you have a complaint or dispute, please contact us first at support@practitionerethics.com so we can try to resolve it. This does not affect your right to contact a consumer protection agency or to use any other available dispute resolution process.
